65. It's true. You and the Oaf Makers are misinformed.
Edited on Tue Feb-23-10 03:56 PM by TexasObserver
If a law enforcement officer refuses the president's orders in a time of martial law, the military will arrest and disarm him.

You seem incapable of understanding emergency powers, except to imagine that some cop in West Virginia gets to decide whether the president has authority to act. NO. That cop in West Virginia only has a right to follow orders or QUIT being a LEO.

Being a LEO is granted by the state. It can be yanked any time. As for the gun, if his side arm is his, he can keep it, unless he's taken any action which makes him a risk to the federal government, in which case it can be impounded and he can be arrested.

The Oaf Makers are a right wing group tied to the fringe groups that attack Obama and his legitimacy.

              - depends on if its a legal order or not, im pretty sure there have been times when presidents have  vadawg   Feb-23-10 06:48 AM   #27
                 - So a bunch of LEOs are supposed to question the President's authority?!  TexasObserver   Feb-23-10 07:06 AM   #29
                    - nope if the orders he gives are illegal then he can pound sand  vadawg   Feb-23-10 07:09 AM   #30
                    - Then you'll be lawfully arrested by feds and held as an enemy combatant.  TexasObserver   Feb-23-10 07:13 AM   #32
                       - so i guess your take on it is that if a president tells you to torture someone for info  vadawg   Feb-23-10 07:28 AM   #34
                       - The Oaf Keepers aren't talking about torture, but about martial law.  TexasObserver   Feb-23-10 07:31 AM   #35
                          - and the question still stands if you believe what you are getting is an illegal order  vadawg   Feb-23-10 07:35 AM   #36
                          - If you believe that, then your duty is to resign, rather than be insubordinate.  TexasObserver   Feb-23-10 07:37 AM   #37
                          - nope i disagree, how many times do i have to say it, if its an illegal order you dont have to resign  vadawg   Feb-23-10 07:40 AM   #39
                             - Since when to LEO's get to decide what is constitutional and what is not?  kestrel91316   Feb-23-10 01:00 PM   #54
                             - They have a duty to disobey orders to commit illegal acts.  Fire_Medic_Dave   Feb-23-10 03:48 PM   #62
                                - They have a duty to follow orders OR QUIT.  TexasObserver   Feb-23-10 04:06 PM   #68
                                - Sorry, they do not have a duty to torture a prisoner if they are ordered to do so.  Fire_Medic_Dave   Feb-23-10 04:11 PM   #69
                                   - Most cops don't need to be ordered to torture prisoners. They are quite happy  kestrel91316   Feb-23-10 04:48 PM   #74
                                   - So you think the over 50% of the over 700,000 law enforcement officers in the US torture prisoners?  Fire_Medic_Dave   Feb-23-10 06:55 PM   #76
                                   - But a Presidential directive to torture would have to be obeyed, right?  Fire_Medic_Dave   Feb-23-10 07:00 PM   #77
                                   - Do you believe he has to obey an order to torture someone?  Fire_Medic_Dave   Feb-24-10 10:24 AM   #79
                                - Who decides if a presidential declaration of martial law is legal or illegal?  kestrel91316   Feb-23-10 04:47 PM   #73
                                   - No one said the declaration of martial law would be illegal.  Fire_Medic_Dave   Feb-23-10 06:44 PM   #75
                             - Yes, you do have to resign, because you're insubordinate otherwise.  TexasObserver   Feb-23-10 02:18 PM   #56
                          - Not if you intend to keep the badge and gun, you can't refuse the president's order.  TexasObserver   Feb-23-10 02:27 PM   #57
                             - He has continually asserted he has the right to refuse illegal orders. Quit making things up.  Fire_Medic_Dave   Feb-23-10 03:45 PM   #60
                                - And he's wrong, just as you are.  TexasObserver   Feb-23-10 03:48 PM   #61
                                   - So you believe he has to obey an order to torture someone?  Fire_Medic_Dave   Feb-23-10 03:51 PM   #64
                                   - Again, do you believe he has to obey an order to torture someone?  Fire_Medic_Dave   Feb-24-10 10:23 AM   #78
                                   - One more time, do you believe he has to obey an order to torture someone?  Fire_Medic_Dave   Feb-25-10 11:30 AM   #80
                          - Pretty bad attempt at a dodge. Can you answer the question?  Fire_Medic_Dave   Feb-23-10 12:08 PM   #51
                             - cant see where i dodged the question n/t  vadawg   Feb-23-10 12:11 PM   #53
                             - I was responding to post # 35.  Fire_Medic_Dave   Feb-23-10 03:41 PM   #58
                             - It's pretty simple. The president can invoke martial law.  TexasObserver   Feb-23-10 02:16 PM   #55
                                - That is simply false. You don't have to obey illegal orders.  Fire_Medic_Dave   Feb-23-10 03:43 PM   #59
                                - It's true. You and the Oaf Makers are misinformed.  TexasObserver   Feb-23-10 03:55 PM   #65
                                   - So he has to obey a President's order to torture a prisoner, if Martial Law is declared?  Fire_Medic_Dave   Feb-23-10 03:57 PM   #67
                                - So you are saying he must torture someone if the President tells him to...  Fire_Medic_Dave   Feb-23-10 03:50 PM   #
                       - no but im pretty sure my state knows enough constitutional law  vadawg   Feb-23-10 07:39 AM   #38
                       - So, if the president invokes martial law, you will not necessarily obey him, but ...  TexasObserver   Feb-23-10 07:44 AM   #40
                          - yup if its an illegal order, as i said he or she can pound sand..  vadawg   Feb-23-10 07:50 AM   #41
                       - LOL, that's a good one. How long does it take for you to come up with these?  Fire_Medic_Dave   Feb-23-10 12:10 PM   #52
                    - That is some world class conclusion jumping. I award silver!! n/t  galileoreloaded   Feb-23-10 08:59 AM   #46
