I just realized something else this Order does that has to enrage the bushcheney admin and that is:

By giving the defense and Fitzgerald until Monday to submit their responses, he has ENSURED that the issue won't be lost because of the July 4th holiday! They submit their responses on Monday, he takes a day or two to rule, makes his ruling AFTER the public are back at home and at work which means the hope of the bushcheney admin that their travesty of justice actions will be hidden is foiled. It WILL NOT be lost due to timing.
