Justices Give New Life to Suit of Quayle's Accuser


Washington, June 12 (AP) - The Supreme Court Today revived, at least
temporarily, a lawsuit against Federal prison officials by a former
inmate who says they improperly confined him to prevent him from
disclosing that he once sold marijuana to former Vice President Quayle.


The Justices ordered a lower court to reconsider a ruling that threw out
the lawsuit by the former inmate, Brett Kimberlin, who argued that he was
wrongly disciplined just before the 1988 election to stifle his
accusation about Mr. Quayle.


The Court ordered the review of Mr. Kimberlin's case in light of a ruling
today in an unrelated case from Illinios. In that unanimous ruling, the
Justices made it harder for some public officials to claim they are
immune from lawsuits alleging violations of civil rights.


Mr. Kimberlin's lawsuit bad been dismissed because he offered only
circumstantial evidence to support his claim that he was improperly
disciplined. A federal appeals court said he needed direct evidence to
pursue his claim.


Mr. Quayle has denied buying marijuana from Mr. Kimberlin and the DEA
later concluded the accusation was false.


In 1988, Mr. Kimberlin was being held in at the Federal Prison in El
Reno, Okla., for drug conspiracy and involvement in eight Indiana bombings.


Four days before Mr. Quayle was elected VP on Nov. 8, the director of the
Bureau of Prisons, Director J. Michael Quinlan, canceled a prison news
conference at which Mr. Kimberlin had planned to say he sold Mr. Quayle
marijuana during the 1970's. Mr. Quayle was a law student at Indiana
University at the time. Mr. Quinlan also ordered Mr. Kimberlin placed in
special detention.


Mr. Kimberlin sued Mr. Quinlan and a former Justice Department spokesman,
Loye Miller, saying they violated his constitutional right to free speech.


Mr. Kimberlin was released from prison in February 1994 after serving 14
years.
