71. At this time, it is still "alleged."
Cobb, et al., claimed that the process used in certain counties in Ohio was not random. That issue has not been adjudicated, so it is still "alleged." Whether it is a "fact" is unknown, and open to at least two opposing answers (depending on the court's judgment on the definition of "random").

To quote the news article on Cobb's own website (http://www.votecobb.org/newsclips/2005/apr/news2005-04-09.php, published 6 days ago):

"(Cuyahoga County Prosecutor Kevin) Baxter said he didn't know yet whether the allegations have any validity." and "The complaints allege that the board violated state law..."

Yes, they are only allegations at this point.
