As it is he can't prove specific harm to a specific person (we don't know *which* votes in particular weren't counted), so the basis of his case has to be fraud by a government contractor. If you're suing essentially in the name of the government, the government gets to look at it and decide if it wants to take the case itself.

AFAIK even if the government takes the case, the original plaintiff can still file & appear separately, but I might be wrong.
