Mounir al-Motassadek is the only person anywhere in the world to have been convicted in connection with the 11 September attacks.
But Germany's Supreme Court threw the verdict out and ordered a retrial a year after his conviction.
The Moroccan was originally sentenced to 15 years in prison by a court in Hamburg for his alleged role in the hijacks.
But the top court later ruled he had been denied a fair trial because the US refused his defence access to a suspect Washington holds.
Information used in Mr Motassadek's trial was believed to have come from the internee, Ramzi Binalshibh.
Mr Motassadek's defence said there was no way to cross-examine the evidence - or even know for sure where it came from.
The prosecution in the retrial had hoped US intelligence agencies would reveal more information about their sources.
But the Justice Department said it would not allow al-Qaeda suspects in US custody to testify.
The defence argues that any information coming from THE US GOVERNMENT may have been got by TORTURING SUSPECTS, and is therefore unreliable.
