CRIMINAL possession of a handgun? Burress isn't a criminal, he's a just another celebrity who possesses a firearm to protect himself from people who--well, criminally possess firearms. In the wake of NFL players being murdered, robbed, and rendered a paralyzed amputee by guns, taking the time to obtain a legal gun license is time a celebrity simply doesn't have.

Unlawful discharge of a firearm? The gun went off when Burress tried to stop it from falling from his waistband, not as a result of his pulling it out and pulling the trigger. Negligent, yes, but an accident all the way. If anyone's at fault, it's the club's doorman for letting Burress in though he knew he was armed--something that most likely WOULDN'T happened had Burress NOT been a celebrity. The doctor who treated Burress was required to report the wound to the police but didn't--again, most likely because Burress was a celebrity.

Burress' laywers will have no problem getting the jury to "understand" that he acted illegally, but with with the most honorable of intentions. And of course Bloomberg realizes that--given the circumstances, a plea bargain and probation are most likely. Bloomberg is more than intelligent enough to realize that--his diatribe was nothing more than self-serving political posturing, from which he'll have to "settle" for having come down on the "right" side of the issue.
