Yes, vasectomies can fail but the father should still have a right to a paternity test if he believes the child is not his. You're talking 1-2% chance that the vasectomy fails which means this guy had every right to have a paternity test done.
The judge used presumption of paternity to deny this man the right to use a paternity test to prove he was father. Now this man's life was ruined AND the child's life was probably ruined too (How does a kid deal with a man saying "No you're not mine"). Had the judge allowed this 15 years ago the whole mess would have been cleared up with lil impact on the child. Perhaps the real father could have been found or at least the mother could have raised the child without dealing with an unwilling person forced to raise a child not his own.
The woman was clearly sleeping around on her husband and yet managed to screw an innocent man over into forced payments.
This law needs to be challenged and updated.
And with someone not only with family in Millville - I'm not shocked at how the asshole judge reacted. He should be disbarred in my opinion. Denying a petitioner the one test to prove whether or not he was the father. Shame on him. Instead the judge used antiquated 'family value' laws created by rightwing assholes you'd find in Northcentral PA and destroyed a family instead.
