It is the ipod- over time (like with a computer HD) the drive gets defragmented. The best thing to do is reset the ipod (I think it is holding down the center button and lower button at once but if you have a newer ipod I would check the apple site to find out how to reset).
I was VERY nervous to do this b/c with music on my ipod, even though I couldn't load new music on to it I could still listen to music.
After resetting the ipod I plugged it in and reloaded all the music again and it worked fine.
