8. They illegally communicated classified national defense information
Regardless of the source, Rove and Libby certainly knew Plame's role in the CIA was classified and that they were crossing the line in telling journalists. Then they tried to cover their tracks and lied about the sequence of events.
In the Franklin/AIPAC indictments press release, prosecutor Paul McNulty stated that unlawful delivery and transmission of classified info related to the national defense had occurred to persons not entitled to receive it including members of the media in an effort to influence. He also stated that "those entrusted with safeguarding our nation's secrets must remain faithful to that trust". Hopefully Fitzgerald will issue a similar press release when indictments are issued explaining the rationale.
