Kennedy has been a recent RW monkey in hopes that he would get job, but with the election fiasco, O'Conner and Rehnquist didn't want to quit and have that as a legacy, so Kennedy got punked (I think the monkey would have picked 'Tony personnally imo). Also, if there is a repeat election fiasco, does the SC, which has endured a searing credibility problem because of the last one, do they wade into the shit again, or this time, stay above the fray to salvage what remaining reputation they have???
Unfortunately, the GOP stopped many Clinton Federal appointments, and Bush has packed several idealogues into the lower courts, but if the SC is tilted back to the left, the damage could be mitigated.
