119. Because of the federal Defense of Marriage Act (DOMA), which outlaws equal marriage.
And because 40 states - including Texas - passed constitutional amendments making it illegal for gay couples to marry or enter into any kind of legal contract, like civil unions, that approximates the rights of marriage.

There are many court challenges. If you are interested, read up on Legal Lambda. Also, the court challenge in California against Proposition 8 will wend its way to the Supreme Court.
