State asks Supreme Court to step in, halt restraining order

The Walker administration went directly to the state Supreme Court on Thursday to get it to lift an order blocking implementation of a controversial measure that sharply curtails public employee bargaining rights, telling the high court that a Dane County judge unconstitutionally overstepped her authority.

With an open meetings lawsuit over the measure still months away from a decision, lawyers for the state Department of Justice and the state Department of Administration asked the high court to end a restraining order issued by Dane County Circuit Judge Maryann Sumi, saying she does not have the authority to stop legislation before it becomes law.

The action filed by the state Department of Justice and the state Department of Administration is not an appeal of Sumi’s order but is instead a request that the high court step in and decide matters that are “of great public concern that go to the very heart of our constitutional system of government.”

The Walker administration is challenging Sumi’s authority to order that implementation of the union law be temporarily barred while a lawsuit filed by Dane County District Attorney Ismael Ozanne over an alleged open meetings violation proceeds. Ozanne’s lawsuit alleges that a legislative conference committee violated the state’s open meetings law on March 9 when it met to approve a whittled-down version of Gov. Scott Walker’s budget repair bill that removed fiscal elements................
