if they had dna evidence and 24 witnesses and one of them now forgets, the prosecution still has dna evidence and 23 witnesses. on the other hand, if they're left with zero witnesses, then the merit of a new trial is obvious.
not sure exactly where the cutoff ought to be, but, well, somewhere in between.
