1. This is why Ginsburg should have retired last year.

Something this guy forgot is that if Obama wins reelection theres a chance Breyer would also retire late in his second term, after Ginsburg.

And if Romney wins he likely gets to replace Ginsburg and Kennedy. My guess is Breyer would hold on until at least the president after 2016.

Obama reelected continues the balance of 4 liberals, 4 conservatives, 1 swing vote.

Romney wins gives conservatives complete control with 6 conservatives vs 3 liberals.
