39. Why sympathetic?

Don't get me wrong, I don't know that the 'book' should be thrown at him either, by a vindictive jury, but I am curious why he should be shown a jury biased in either way?

Yes, he was a victim of a crime, but the response was disproportionate to the injury the initial victim received.
