They are selective fire and the difference is important.

Take for example the Ruger Mini-14. Its a ranch rifle. Handy carbine with a wood stock, often a small scope. Its not considered an assault rifle, even in California. But:
- It fires the .223 round
- Has all sizes of magazines available for it, including snail drums.
- It can be dressed up to look scary.

If you want to base original design/intent as the reason for banning things, be prepared to give up a whole lot of stuff from GPS to the tin can.
