I think it stinks whenever a state elects not to implement the ACA exchange provision or to accept the expansion of Medicaid, but the fact is that the ACA expressly allows states to opt out of setting up exchanges (leaving it to the federal government to do it for the state) and as upheld by the SCOTUS, states are allowed to opt out of the medicaid expansion.
