Most people are not good judges of how well they can drive when they've been drinking. In fact, alcohol will often make you think you can do something when you can't.

Good. If you go out drinking for an evening with someone, you should know that they can't drive.

If the statute requires knowing conduct they have to prove the mens rea of knowledge.
