Police spies court case suggests sexual relations with activists were routine

Lawsuit for undercover police deception indicates several officers struck up intimate relations with those they spied on

Hundreds of political activists were bedding down in a field near the Drax power station in North Yorkshire. It was August 2006 and eco-activists had erected tents beside the UK's single biggest carbon emitter.

As night fell on the inaugural Climate Camp protest the campaigners near the coal-fired station had no idea that their camp had been infiltrated by three undercover police officers.

Mark Kennedy, now the most famous of police spies, and, it now seems, a woman constable known as Lynn Watson were that night inside tents sleeping with activists.

The third, an officer using the alias Mark Jacobs, would soon be doing the same with two women in Cardiff, where he posed as a truck driver to monitor small group of anarchists.

2. That's surely the most over-reaction possible.

I agree it's something that should be discouraged, even outlawed, but to say that women were unwitting victims is to imply they have no common sense. I don't understand the basis of the lawsuit. 'Emotional damages'?

3. You really don't think DU is capable of producing more extreme reactions?

I do think this is the kind of behavior that should allow any police testimony to be thrown out. If people are sexually involved, how can we possibly trust their testimony to be objective and reliable? It's the basis for disallowing spousal testimony. The "undercover" (ha! get it?) cop might fib to hid evidence of a lover's misdeeds, or might throw the light of suspicion on a third party to protect a paramour, or might be vindictive toward an angry ex and trump up charges out of spite, or at the very least might demonstrate a cavalier, dehumanizing, and dishonorable regard for his/her sexual conquests that discredits the officer's worth as a witness.

I'm not a lawyer, but I'll bet a good trial attorney could gin up half a dozen other arguments as to why cops shtupping suspects and witnesses is a horrible idea that fatally jeopardizes the evidence gathered in the course of an investigation.

5. Calling it 'rape' is ridiculous, IMO.

Although, as Scootaloo pointed out below, there is such a thing as 'rape by deception', which I did not know about.

Testimony may not have been an issue here. Perhaps they only wanted to stay apprised of the activities in case something got out of hand. No idea, really.

4. Some nations have a "rape by deception" law that would cover this

And I don't mean like that case in California, I mean like "itt turns out this person wasn't actually who they said they were so I'm taking it to court."

I can see the pros and the cons of such laws, so I'll not comment on that

Imagine yourself in that position as a young adult.

First off, I don't even think undercover spying on people peacfully excersizing their free speech rights should be tolerated.

Then a person in authority lies to you, poossibly over the course of days, in order to gain your confidence and respect. You then have sex with this person based completely on false pretenses.

I stand by my comment and hope you never end up in a situation where you are betrayed in such a dasterdly fashion.
