RNC: Obama’s Executive Actions A ‘Power Grab’

RNC Chairman Reince Priebus rejected President Obama's executive actions on guns in a statement Wednesday, saying they "amount to an executive power grab."

"He paid lip service to our fundamental constitutional rights, but took actions that disregard the 2nd Amendment and the legislative process," Priebus said.

Here's the full statement on Obama's press conference:

“President Obama’s series of gun control measures amount to an executive power grab that may please his political base but will not solve the problems at hand. He paid lip service to our fundamental constitutional rights, but took actions that disregard the 2nd Amendment and the legislative process. Representative government is meant to give voice to the people; President Obama’s unilateral executive action ignores this principle,” said RNC Chairman Reince Priebus.

“Instead, we need to work together to find real solutions – many of which do not come from the federal government – that help protect our children and communities while also being firm in protecting Americans’ constitutional rights.”

Some one should tell those whiny malcontented GOP gun nuts that Obama is the duly elected President, he gets to wield the power, if the GOP dont like what he's doing,,,tough,you get some one up there as President then you can wield the power, maybe start some new wars..in the meantime quit the whining as it isnt what Americans are made of, in fact its embarrassing

2. What are they objecting to? Background checks for all? Mental health parity under the ACA?

I'd like to know how they justify their complaints about those items.

7. Not to mention that precedent has been set. I have been researching this

and pretty much after every incident of mass public violence, an ensuing change in gun laws.

President George H.W. Bush signed an executive order in 1989, not long after the shooting of school kids in California 1/17/1989.

8. I've never been keen on government by Executive Order. . .

I too believe our laws should be worked through the established legislative process.

I'm interested, though, in what if anything the RNC objects to within the proposed executive actions. If they can be forced to give their reasons now, it may make legislative enactment later a lot easier. And if their objections are strictly about the illegality of executive action, will they now propose legislation to nullify all such executive orders, both those given by Democrats as well as those by Republicans?

9. Scotus found in 1952 that executive orders were legal provided they

have a previous act of congress (law) or constitutional power as it's origin. In kindergarten terms, they can enhance an existing law. Something like that. When George H.W. Bush made his ex order I think he used the gun law from the 1968 Gun Control Act. From what i've read, they say Obama could also use the 1934 National Firearms act (levied a tax on guns) or 1938 Federal Firearms Act (required gun dealers to be licensed) to extend existing laws.

Scholar says Bush has used obscure doctrine to extend power 95 times

The Bush administration has been using an extreme version of an obscure doctrine called the Unitary Executive Theory to justify executive actions that far exceed past presidents' power, RAW STORY has learned.

The doctrine assumes, in its extreme form, nearly absolute deference to the Executive branch from Congress and the Judiciary.

According to Dr. Christopher Kelley, a professor in the Department of Political Sciences at Miami University, as of April 2005, President Bush had used the doctrine 95 times when signing legislation into law, issuing an executive order, or responding to a congressional resolution.

Obama: 143
George W. Bush: 291
Clinton: 363
Reagan: 380

ALL presidents here: http://www.archives.gov/federal-register/executive-orders/disposition.html

Executive orders are official documents, numbered consecutively...


p.s. The link above is a good one to keep handy to refute the right-wingers that always FALSELY say that Obama has issued more EOs than Bush and other presidents.
