'Blank this blank' puts woman in jail

LaRue Ford, who has no criminal record, had hoped to spend Christmas with family in Chicago. Instead, she spent the holiday in the Berrien County Jail.

She is still locked up there, has been for eight days.

Her offense, according to court records: "profanity in the clerk's office."

"She said, 'f--- this s---,'" said attorney Megan Reynolds, who is working on her case with several other
ACLU attorneys.

this is getting to be. I was reading somewhere, and I think it's Arizona, ... is mulling a bill that would make it illegal to criticize the government on the internet. Here it is, and it's based on interpretation of what one said ... (like disorderly conduct), then I hope the clerk gets voted out of office for wasting taxpayer money. In this day and age, it's incredible that any elected official would violate someone's right to free speech. This seems like a slam dunk case for the ACLU.

then, though there might be disorderly charges, i am guessing they have a pretty good case. they aren't going to represent just anyone who get thrown in the clinck for causing a ruckus at the county courthouse. they are fairly discriminating in what they take on.

98. I live in Berrien county and I can promise you that you are right.

Also qualifying you would be being poor, or not connected. The courts here are only just for the rich and connected. I know lawyers kids and judges kids in St. Joe who have been up on multiple charges; drunk driving, stealing, drunk and disorderly, even hitting a police car while drunk. None have served jail time. All are white.

aren't voted in - they are administratively hired. I know the legislators don't have to take their advice, but in many states the legislative attorneys have a section attached to bills where they can comment on the likelihood of the bills constitutionality. Does Arizona do that?

It well might be that in some cases they don't solicit or perhaps ignore their advice if it were solicited. It all sounds quite strange to me with reference to these laws, overreaching, and in fact, persecutory and a violation of the US constitution (I would think.)

The law states the language is liable "if done with intent to ‘annoy,’ ‘offend,’ ‘harass’ or ‘terrify,’ ".... but then the law goes on to clarify that "there is no requirement that... the communication must be intended to offend or annoy" in order to be liable.

was in consideration as George W. Bush's running mate. I know right? How could it be a guy like that has no respect for civil liberties? Here is Gov. Engler's partial bio from Wiki.

His administration was characterized by privatization of state services, tax reduction, educational reform, welfare reform and major reorganization of executive branch departments. In 1996 he was elected Chairman of the Republican Governors Association and in 2001 he was elected to head the National Governors Association

Oh, and how did a pre-tea party tea bagger get elected in Michigan? Well not to say that the GOP might fix an election or anything, but according to Wiki (which I know can't be trusted completely) but.....

In 1990, State Senate Majority Leader John Engler challenged Governor James Blanchard in his bid for a third term. Political observers viewed Engler's bid as a long shot, and he trailed Blanchard by double digits in the polls the weekend before the election. However, on election day Engler pulled off the upset, defeating Blanchard by approximately 17,000 votes – less than one percentage point

As for the judge, well he received the Thomas Jefferson Center's Muzzle award. 2 times in 3 years. Google his fight w. Pinkney, also involved ACLU. No wonder they were on speed dial for this woman. They knew his politics.

96. I knew a similar case from the 90s

A family friend who was a young attorney had a contentious session with an established, old cranky judge...

AFTER leaving the courtroom and walking out the court building, he complained to a friend how much of an asshole the judge was, so the security guard at the front door ran into that courtroom, told the baliff who told the judge, and before my friend reaches his car in the parking lot, he gets dragged back into that courtroom, charged with contempt and spends a couple nights in jail...true story...You better believe that judge wanted to send a message on what my friend's "place" was...

Rachel Maddow covered the Berrien county- Benton Harbor area on her show. The area is about 80% black and yet, neighboring St. Joseph MI is about 80% white and rich.

My friend was up on some traffic-related offense and the judge broke for lunch, telling us to come back in 45 minutes.

We came back, but the judge didn't. She left us standing in the hall for another hour. When she and some attorneys finally showed up, I said, "Welcome back to your courtroom, I hope we haven't caused you any inconvenience".

Guess who spent the night in jail?

i can totally see a judge slapping her with a <$100 fine or something. i really can. i have no problem with her being punished for this. but what they have done to her is rediculous and really amounts to cruel and unusual punishment imho

67. I was talking to someone recently that had moved out of Michigan. Young, bright and

looking to advance, nice guy, concerned about people. He had lived in someplace in Michigan, not sure where ... he said it was so crazy and right wing he had to get out even though he was a native and born there. He literally feared for his life because he was not right wing crazy. As soon as he finished college he left.

Where I live now is getting more and more right wing. I don't even like the people I see in the stores some look sooo teabaggerish. Now they want to walk around with guns strapped to their sides. The state says OK, but some of the local municipalities are trying to fight it ... we must look like absolute fools to the rest of the world.

I drive cross country sometimes. Sometimes I'm a bit nervous about it ... I stopped off one place to eat and some clearly right-wing teabagger looking type started rattling off something to me, got in a huge van and drove off talking away. Guess he didn't like my hair or something, I don't look like Glenn Beck. The restaurant was full of them.

That she posted the 10% of her $5000 bond but the judge revoked that due to no mailing address (which may mean homeless or living here and yon with relatives). Either way...she was not in court....she was in the clerk's office....and walking away. If someone cannot mutter to themselves...there ain't no such thing as freedom of speech.

Really, this is one where it should go all the way.

It doesn't even seem like she directly cussed at the court clerk. So she lost her temper - she had spent months trying to comply with their laws.

What is going on here?

I couldn't open the link, but I saw in the comments, someone googled on the judge who did this to that innocent woman. Found he was corrupt as hell, apparently.

Sounds like the whole place is corrupt as hell.

But truthfully, unless this speech had the effect of disrupting court processes (non-protected speech), it does clearly have constitutional protection. As described, the incident clearly did not have that effect.

But again, this is why you need lawyers who are funded to smack this sort of thing down. The fact that it is unconstitutional does this woman no good unless she can access the legal talent to enforce her rights through the courts. Cohen V California comes to mind, among other cases. No matter how expressed, a government does not have the right to punish a citizen for an expression of that citizen's opinions on the state's conduct.

A government can censure interference with a proper government agent acting in the conduct of his/her duties. So you can't stand up in a courtroom, start cussing and disrupt court proceedings.

But stating one's disapproval of a particular government action or procedure or decision is constitutionally protected speech.

that she had just moved to Indiana and was trying to get her CDL there, but they wouldn't allow it until she paid off an old ticket in Michigan.

She was not homeless, she just had no proof (yet) of her IN address due to this situation, which seems to have turned rather Kafka-esque. Well, probably plus the racism knowing that part of the state.

but this incident took place in Michigan. Not that there's much difference... southwestern lower Michigan is just as red as northwestern Indiana. The state line might as well not even be there in some ways.

70. I think that might have been where this guy had lived that I mentioned in #67. I took

interest in it that I had once considered relocating to Michigan, but not long after that what he had said started coming out and I changed my mind. I'm trying to get out of RW territory, not move into more of the same. Here, they think if they can get more RW and more religious people are going to flock here. How times are changing.

Phew, I'm glad we have the internet, I've learned a lot about various places. Some pretty freaky and others really good. I think there's going to be more and more of a geographical divide in this country along ideologies. Putin once said he thought the US was getting so polarized the US would eventually break into several geographical regions. Maybe he's onto something.
