(Indian Outsourcer) Infosys Expected To Pay $35M Fine For Alleged Work Visa Fraud

Indian software giant and outsourcing firm Infosys is expected to pay a $35 million fine to settle visa fraud charges — the largest fine of its kind in United States history.

The government is expected to announce tomorrow that a joint investigation by the State Department and the Department of Homeland Security found that the Indian company gamed the immigration system in order to increase company profits.

Infosys, which is the world’s second-largest software exporter, allegedly used inexpensive B-1 visas instead of harder-to-receive and more expensive H-1B work visas for employees based in the U.S. for long-term assignments

Some state governments are willing to hire offshore outsourcing firms to work on IT projects under controversial contracts that don't bar use of temporary foreign labor, or workers on H-1B visas.

Two multimillion dollar government health care IT projects, one in Illinois and the other in the District of Columbia, illustrate what's going on.

In Illinois, Cognizant was awarded a $74.1 million contract in June to upgrade the state's Medicaid systems to meet the requirements of the Affordable Care Act (ACA), or Obamacare.

In January,Washington D.C. awarded Infosys a $49.5 million contract to develop a health benefit exchange and replace its Medicaid and eligibility systems.

Obama's record on outsourcing draws criticism from the left

Barack Obama promised voters four years ago that he would work to slow the outflow of American jobs to other countries, proposing to revamp a federal tax code that encourages companies to maintain overseas operations.

Obama as president has continued to call for rewriting the rules that allow U.S. corporations to avoid paying taxes for a time on income generated overseas.

But the broad tax changes have not happened.

While White House officials say they have been waiting on Congress to act, Obama’s critics, primarily on the political left, say he has repeatedly failed in other ways to protect American jobs from being moved overseas. They point to a range of actions they say he should have taken: confronting China, reining in unfettered trade and reworking a U.S. visa program that critics say ends up sending high-tech jobs abroad.
