Activists and homeowner evicted from foreclosed house by SWAT team

Sahara Donahue and activists were evicted by the Idaho Springs Sheriff department around 3 p.m. on October 30, 2012. Yesterday, Donahue went to US Bank's main office in downtown Denver and spoke with a VP about getting a 60 day extension before being evicted from her home. US Bank declined to extend the eviction date and forwarded her to Vericrest Financial.

Activists from the Colorado Foreclosure Resistance Coalition (CFRC) and Occupy Denver stayed with Donahue in her home to help prevent her Tuesday morning eviction. A live stream by odarren documented much of Donahue's eviction. On Tuesday around 1 p.m. a truck arrived with a roll-off dumpster, arrived at Donahue's house. After the situation was explained to the driver, he explained before leaving that he had his home foreclosed on two years ago and did not want to be part of Donahue's eviction.

Later in the day a white van parked in front of Donahue's house with 8 to 10 people who were sent to clear out her house. After being stopped by a blockade made from fallen trees and non-violent resistance from activists who were occupying the home, the moving van left. It was reported that at around 3 p.m. the SWAT team arrived, forcing activists and the media to the ground. 3 arrests were made but soon released with citations. Sahara Donahue is currently seeking a place to rent and to secure her belongings.

Most foreclosures are fraudulent and banks are working on tools to make foreclosure ever easier. It is painfully obvious to see that the police and sheriffs are the banks' private army.)

Lack of standing CANNOT be cured or remedied with a later assigned mortgage
Judgement REVERSED and CASE DISMISSED

The Supreme Court of Ohio ruled that standing to initiate a mortgage foreclosure lawsuit is determined on the date the complaint is filed. A foreclosing party, which lacked standing at the time the suit was filed, CANNOT remedy that defect by obtaining an assignment of a mortgage and promissory note AFTER the filing of the foreclosure action but prior to an entry of a final judgment.

The court’s 7-0 unanimous decision dismissed a decree of foreclosure granted to Federal Home Loan Mortgage Corporation FHLMA (AKA "Freddie Mac") against Duane and Julie Schwartzwald because FHLMA did not have standing at the time it filed the foreclosure action.

Food banks in the Tri-Cities are reporting a whopping 60 per cent increase in the number of people needing help in the last five years.

The report also shows the type of people using food banks has changed since the recession -- 11 per cent of users were employed.

“Canadians that actually go to work every single day still are not making enough to put food on the table,” said Marzena Gersho from Food Banks of Canada. “Higher paying jobs that you would see in natural resources… are really disappearing and people are moving into the service sector and of course those jobs just don't pay as well.”

The so called 99 percent have come together in the wake of Superstorm Sandy, with Occupy Wall Street using its grassroots strength to organize relief efforts and help those worst effected by the storm.

Some 750,000 New Yorkers are still without power and at least 18 have been killed, as large swaths of New York City remain under water. Starting in the Lower East side and moving through New York's five boroughs, OWS volunteers have teamed up with international environmental organization 350.org and people-powered disaster aid group recovers.org, to help bring together those in need with those wishing to aid the relief effort.

With social media as their beacon, the OWS is using the limitless organizational power of the web to make a real impact on the ground with the help of local churches and city agencies. Occupy asked those wishing to get involved to tweet using the hashtag #SandyVolunteer and for those who need help to tweet using the hashtag #SandyAid. They have also set up a Facebook page to help coordinate logistical efforts.

-Occupy Melbourne Legal Support Team has authored and released a qualitative report, entitled "Occupy Policing: A Report into the Effects and Legality of the Eviction of Occupy Melbourne from City Square on 21 October 2011

Occupy Wall Street and 350.org have teamed up with Recovers.org, a disaster relief platform, to help coordinate response to Hurricane Sandy. OWS states on its website that they are launching support pages at Recovers.org for individuals to give help or post a need. At the interoccupy.net hub, users can make financial donations to victims, volunteer their efforts or locate an emergency shelter.

OWS has called on anyone with “experience in or tools for medical and psychological services, electrician work, plumbing, construction, financial or legal services, debris and tree removal, childcare, transportation, senior services or language skills” to sign up at one of three current sites in the Lower East Side in Manhattan, Red Hook in Brooklyn and Astoria in Queens—all of which are along the waterfront and experienced flooding.

Drop-off points have been established throughout Brooklyn where people can drop off candles, flashlights, batteries, water, food, or other amenities, RT.com reports.
