So, maybe I'll be surprised Thursday. Here's hoping Kennedy can somehow muster enough compassion to do something he rarely does.

on edit: I misread the OP. I thought it was about the Montana ruling.

I was fully expecting them to rule in favor of Arizona on every issue. They didn't.

I knew the court wasn't going to overrule itself only a couple years after their original ruling. Disappointing, but expected.

It was suggested that Roberts joined the Kennedy opinion in return for Kennedy's support in overturning the PPACA.
