Charged With Killing Woman In S.F. Should Have Been Deported

Hillary Clinton said San Francisco “made a mistake” when it released Francisco Sanchez despite requests from federal immigration authorities.

In her first national TV interview as a presidential candidate, Hillary Clinton said Tuesday the undocumented immigrant charged with killing a woman on San Francisco’s waterfront should have been deported. The fatal shooting of Kathryn Steinle, 32, as she strolled with her father last week set off a national debate about San Francisco’s policy to only honor immigration holds for people with violent records or who have an outstanding arrest warrant. U.S. Immigration and Customs Enforcement had asked the San Francisco County Sheriff’s Department to hold Francisco Sanchez, but the agency declined based on policies established in 1989.

On Tuesday, Sanchez pleaded not guilty to charges that he murdered Steinle.

“The city made a mistake, not to deport someone that the federal government strongly felt should be deported,” she told CNN. “I have absolutely no support for a city that ignores the strong evidence that should be acted on.” Clinton said she was completely behind immigration reform that includes a path to citizenship.

According to records with the Department of Homeland Security, Sanchez had been deported five times, most recently in 2009. He has seven felony convictions, four involving narcotics charges. “He was deported five times,” Clinton said. “He should’ve been deported at the request of the federal government. But had he been picked up on small infractions, such as a first time traffic citation, “that’s something entirely different,” Clinton said.

Other jurisdictions have followed in San Francisco’s footsteps. Some after a federal judge in Oregon ruled last year that an immigrant woman’s civil rights were violated when she was detained on an ICE hold.

First of all, let's not confuse the City's Sanctuary City policy with its relationship with ICE. Sanctuary means that a resident can report a crime, help police as a witness, seek medical treatment and send their kids to school without having to answer question about whether they are documented. This helps people ANY city should want. On the other hand, the City has a bad habit of not reporting people to ICE that we don't need.

Edwin Ramos assaulted a pregnant woman on a bus in front a dozen witnesses. Despite his undocumented status and despite his known gang affiliation, the City let him loose without contacting the feds. And in 2008, he murdered a man and his two sons that he mistook for rival gang members. Fast forward to this year, the SF Sheriff Ross Mirkarimi failed to let ICE know that they were going to let Francisco Sanchez out and he just murdered a woman with a gun he stole out of a car. And Mirkarimi is making excuses for the fact that they didn't hold him until ICE was able to get a court order to turn him over.

3. Why would any LEA let him loose?

Why didn't they incarcerate him and send him to stand trial for his crimes? Is there some kind of legality that prevents our judicial system from meeting out justice to illegal immigrants? Or is it about the money and cost of confining people? 7 felonies? I wouldn't be walking the streets after 1 felony especially a violent one.

The feds picked Sanchaz up for crossing the border again and, after learning about a 20-year old pot warrant. The judge dismissed that charges since we (rightfully) no longer care about pot. Here's where it gets sticky. ICE said they informed the SF Sheriff Ross Mirkarimi that they wanted him turned over for deportation and Mirk ignored them because they didn't get a court oder. So, Mr. Sanchez was released to take in the sights of our beautiful city and kill someone along the way.
