Ron Paul Ups The Ante And Claims Sexual Harassment Shouldn’t Be Illegal

A vote for Ron Paul is a vote for sexual harassment.

What Ron Paul was saying here is that there should not be any federal laws against sexual harassment. There should not be any civil rights protections for women and some men in the workplace. In other words, sexual harassment should be legal. Rep. Paul’s statements today reflect his ideology taken to its logical conclusions.

1. About that syntax...does that mean some men should have civil rights protections in the workplace?

Anyway you read it it's an outrage, but I'm wondering who those special men might be.

3. Ron Paul is out of the picture, except possibly as a spoiler in a few close cases.

Nevertheless, those who like him for his opposition to the Iraq/Afghanistan wars should be aware of where he stands on other issues, like this one - where he is a far, far right libertarian who doesn't think the government should do anything, ever, to help or protect people.

I do not ever want to see another word spoken in that Neanderthal's favor here on DU.

We shouldn't speak a word in favor of any Neanderthal. And by Neanderthal I mean the members of the white-elite, wealthy, racist Republican party.

But we should realize that Ron Paul is the most dangerous out there. He is even more dangerous than Santorum who at this point is a laughingstock more than anything else.

8. After arguing with a bunch of Ron Paul followers on YouTube,

I have come to the conclusion that deep down, many of them are aware of his stances on other issues besides the wars and marijuana. But they either agree with him in those stances, or they want to believe in him so much that they pretend the media is out to get him, or his rivals are lying about him.

11. The claim that Paul said it shouldnt' be illegal is not 100% true

 

He said, "But if sexual harassment involves violence as libertarians, we are very opposed to any violence. So, if there is any violence involved, you still don’t need a federal law against harassment. You just need to call the policeman and say there’s been an assault or there’s been attempted rape or something."

He also did not say whether it should be up to the States to decide if sexual harassment should be illegal; therefore, I would use the qualifier "federal".

17. It is illegal. It may or may not be a criminal offense -

if there was also an assault and/or battery, it would be a crime under most state laws. But it is illegal because it violates federal and many state statutes. The consequences are civil rather than criminal penalties and/or a monetary award to the plaintiff, but it's illegal. Illegal = against the law: any law, not just a criminal statute. Sexual harassment is against the law (Title VII of the 1964 Civil Rights Act, section 703, specifically).

This is tortuous logic for what is essentially a tort. In ordinary speech, people understand "illegal" to mean a breach of the criminal code, not a definition of what can produce a civil liability. As a matter of a breach of criminal code, sexual harassment is not illegal. As I said in my previous post, nobody ever got arrested for sexual harassment (though, certainly, people have been arrested for assault and/or sexual battery).

I'm a retired lawyer. I handled some sexual harassment cases. Trust me: it's illegal. But don't take my word for it; here's what the American Bar Association says:

Yes. The U.S. Supreme Court has held that Title VII's prohibition against sex discrimination includes sexual harassment as a type of illegal sex discrimination. Most other states interpret their laws prohibiting sex discrimination to include sexual harassment.

Illegal means against the law - civil or criminal. It means the authority of the state can impose some kind of penalty on you. It doesn't have to be criminal.
