Ohio Secretary of State accused of installing suspicious software on voting machines

The Columbus Free Press is reporting that the Ohio Secretary of State Jon Husted allegedly ordered for “experimental software patches” to be installed on vote-counting machines in a number of Ohio counties.

According to the newspaper, voting rights activists are concerned that the software patches, which are usually used to update or change existing software, could potentially affect over 4 million registered voters, including those who live in Columbus and Cleveland.

Ohio law allows for the experimental use of voting equipment as long as it’s restricted to a limited number of precincts, and under the experimental label, equipment can legally be used without certification.

The Free Press revealed the contract between Husted’s office and the contracted vendor Election Systems and Solutions reads that the software has not been and does not need to be reviewed by any testing authority at the state or federal level.

55. Sorry to disagree with you......

The election will be decided in a handful of so-called swing states. This year they include Ohio, Florida, Virginia, Pennsylvania, Iowa, Colorado and Nevada.

If the OH SoS has installed software on these machines that flips votes for BO to Robme, he might take the state.

I wish I could believe that public officials would, regardless of political affiliation, respect the election process and guard it with care. But we know that the GOP doesn't like to play by the rules. They have publicly admitted they play around and game things when they can.

So please don't be so assured that BO will win. Even if the will of the people is for him to serve another 4 years, the power is NOT in the people. The power is in those that count the votes. Remember that.

Due to fact that many places in typically Democratic strongholds have no power. East side neighborhoods in NYC, then there is Long Island, and SeaSide Heights in New Jersey. A lot of other areas as well.

Add to that the voters who are being "purged" from voters' lists and those whose vote will be hacked, and even if he doesn't lose, none of us will ever know the real tally as to what voters really decided.

Cheating at elections is wrong, and it's way past time for it to be investigated and stopped. I am still furious about the way the 2000 and 2004 elections were stolen.

69. Very well stated. And one other thing - it's not just the Office of

President that is being voted on.

Maybe Obama has the type of lead to overcome all the significant voting purges, vote hacks, mis-labelled and wrongly addressed early voting "absentee" ballots, but even if he does, there are tens of thousands of other candidates whose ability to get into office could be affected. People need to realize that, and not demand all of us to shut up about election theft, as though our concerns show us less than loyal to the President.

It is not all about President Obama.

These bastards are using every dirty trick they have from voter purging to sending voter information to minority voters with the wrong information on it to throwing away voter registrations to manipulating the software.

It's a serious problem & I have to question if those who are flippant about it are paying any attention.

I'm more worried that the "Buggy Software" was already on these machines. The patch covers up the tracks.

With the massive GOTV campaign that the Dems had, I wonder if all of those early votes were already flipped on the machines. When the Tuesday election happens, those vote flipping machines have been patched and work properly.

I keep hearing, I heard it just an hour ago from John Kerry, that the Obama team is lawyered up everywhere big time. Let's hope so - Kerry got screwed out of this state big time in 2004 by Blackwell. Overall, almost all polls showed Kerry even further ahead nationally than Obama now. What happened? - of course the exit polls got blamed.

Beyond this Romney apparently has it's swing state commandos ready to hassle and lie, ready to slow the vote down in dem areas. The answer to how low can you go, for this bunch, is pretty low.

We've had 8 years to make sure the voting wasn't rigged. 8.

If we can't figure out a way to insure it's honest, then we're not competent enough to deserve to run the country.

If there's any question at all about this patch, we need to find a Democrat Sheriff in a Democrat county with a Democrat Judge, and we need to have them seize a couple voting machines from around their county (regardless of what anyone else may tell them to do-- they've got to be willing to take some heat) and have the contents copied to a hard drive immediately. That's literally the only way to make sure. If you wait until after the election, the code could have already self-erased itself-- it could be programmed to erase itself after a certain time, after a certain number of votes, whatever. You can't just seize the machine and leave it alone, because when you turn it on it might detect the time and self-delete. You need to copy all the contents to an external machine so the software can be analyzed later.

I'm assuming the people in charge know all this (and probably a lot more). If not, well, we deserve what we get. This isn't rocket science.

The results. Remember, it only takes one US senator the challenge the results. At that point, the Senate as a whole will vote to decide who is president. Democrats currently have a 53 to 47 majority so you do the arithmetic to see how that vote will be decided.

90. You are correct and any state that does not abide by its own state constitution

when conducting its election violates it own laws and thus can have its slate of electors NOT COUNTED during the Electoral College Voting. There are rare precedents for slates being disallowed, but it has happened. I did a lot of research on this very issue during the 2004 election and reported it here.

Do I think the Electoral College would disallow for instance Ohio for violating its own state constitution in tabulating the votes? Odds would be slim, but if there were absolute proof it had happened, enough pressure by the constituents and independent voices which monitor election integrity could cause enough outrage the Senate would have to consider it.

and not certify the results in time for the Dec. 17 elector's meeting. I heard a story yesterday on NPR about all the various delays that could delay certification of Ohio's results and Husted is giving out statements hinting to that effect for example in this LA Times article:

And the federal government has no say in how state government's choose to run their elections. Just as in 2000/2004, any legal proceedings are conducted in the state courts. We go through this every 4 years, and no one cares until it's too late. When the election is over all is forgotten until the next time.

The lamestream meida is in on it! Why else would these talking heads keep regurgitating that the polls are tied - when they're clearly not except in the rethug-sponsored ones. The talk is to make people hear the meme that this is all tied up and it could go either way. Why do you think they aren't talking more about the fact that Obama has a 5-6 point lead in the polling in Ohio? They're creating a scenario that can fit the plausible deniability factor.

And as for the Senate being in a position to question the results, well just remember that in 2000 that this wasn't an option because the GOP filed a lawsuit and appealed it to the SCOTUS. They'll do that again.

The GOP have their people and electronic polling computers and software installed in every voting precinct that's meaningful to the bottom line. They can sit there and pick this off one by one and not a sould will be the wiser except those who participated in the creation of the codes that will do this. There won't be any paper trail and no means to question the outcome. And anybody that comes into scrutiny by the Feds will likely wind up dead in a ditch or in a plane crash from and "accident".

Are we some kind of Third World republc? I certainly hope all these 'patriotic' Republicans are proud of fucking up voting so much that we have become an embarrassment!

Someone on DU came up with an interesting idea. If some states are so adamant about electronic voting (we use optical scan wher I live), then the government should call together the best tech minds in the country to come up with the ideal open source software solution. The poster suggested bringing companies like Apple, Google, Microsoft, Dell (to please the righties), etc.

The good thing about open source is that it is all out in the open, and the main software itself cannot be tampered with without someone else noticing it. Any e-voting machine must run the approved software in order to be allowed in any polling place. And there should not be ANY conflicts of interest. So if it turns out that the guy who owns the voting machine company brags about how they're going to deliver the votes for a particular candidate, or any other conflict of interest, the machines get yanked. Period. There is no reason these problems should persist.

There is not enough details in the article to know what is really going on. It likely sounds worst than it really is because if it was really a problem, the Obama campaign would have lawyers and security experts all over it.

The real methods of stealing elections comes from suppressing Democratic turnout. That is what the DOJ is putting its resources into stopping. No need to get into elaborate conspiracies. The real problems are right in front of your eyes.
