Legislative measures aimed at curbing government detention and surveillance of Virginia citizens are working their way through the General Assembly.

Del. Ben Cline’s bill (HB1256), which gained unanimous approval from a House of Delegates subcommittee today, draws a bead on the National Defense Authorization Act of 2012. That law allows federal agencies to detain citizens indefinitely on national security grounds, regardless of whether criminal charges have been filed.

Cline, R-Rockbridge County, believes that’s unconstitutional.

Cline’s bill directs the state secretary of public safety to seek notification from the U.S. secretary of defense within 24 hours whenever a Virginia citizen is detained under the federal law. In addition, before the detained citizen is removed, the secretary of defense would be asked to seek authorization from the chief law enforcement officer of the locality where the detention occurred.
