(CT)Medical marijuana zones out officials

Is medical marijuana production a non-agricultural activity?

There is a difference of opinion between New Milford attorney Jeff Seinkewicz and the New Milford Zoning Commission.

Sienkiewicz argued last week against the commission's proposal to define production as a non-agricultural activity.

The commission is in the process of developing definitions for medical marijuana production facilities, medical marijuana dispensaries and pharmaceutical grade marijuana.

Seinkewicz is representing resident Ken Cherry, who has submitted an application to grow medical marijuana on his Northville property in a residential zone.

The commission proposed to set zones where these facilities could be located: In some business and industrial zones for production facilities and in a business zone for dispensaries.

Seinkewicz argued that by state statute, licensing for the newly approved cultivation of medical marijuana requires the applicant have "expertise in agriculture."
