AG will intervene in Kentucky State Univ. lawsuit against a student newspaper

Attorney General Andy Beshear will intervene in Kentucky State University’s lawsuit against a student newspaper that requested sexual misconduct records

Attorney General Andy Beshear will intervene in Kentucky State University’s lawsuit against a student newspaper that requested records about sexual misconduct.

Like the University of Kentucky, which sued its student newspaper, The Kentucky Kernel, Kentucky State has sued The Kernel in Franklin Circuit Court, disputing Beshear’s late January ruling that the university violated the Open Records Act by refusing to release the requested records.

KSU filed the suit Feb. 23. No court date has been set.

A Fayette County judge sided with UK against the student newspaper after it requested investigation documents regarding a professor in a sexual harassment case. UK refused to allow Beshear to confidentially review the disputed documents, and Kentucky State has done the same.

Beshear will intervene in the lawsuits to uphold the office’s right to confidentially review the disputed documents.
