Republicans are bitterly accusing President Obama of making laws without the approval of Congress. That’s utter nonsense. The EPA is moving against carbon polluters under the Clean Air Act of 1970. The Department of Health and Human Services has full authority to alter deadlines and timetables under the Affordable Care Act of 2010. Immigration and Customs Enforcement has enforcement discretion to go after adults in the U.S. illegally and not go after kids, under the Immigration Acts of 1921, 1924, 1965, and 1990. The legislative branch enacts laws but the executive branch interprets and enforces them. This is how our system works. If Republicans want to amend the laws, they can try. But the reason no significant legislation has emerged from this Congress is Republicans have basically closed it down.
