Probate Judges Association: ruling doesn't mean gay marriage legal in Alabama

MONTGOMERY, Ala. (WAAY) - The Alabama Probate Judges Association issues a clarification on a big ruling.

The association says the ruling doesn't open the door for the issuance of same sex marriage licenses.

They say Cari Searcy and Kim McKeand of Mobile, are the only plaintiffs in the lawsuit at the center of the ruling.

That is a key point in the effect of the ruling, and the duties of probate judges

Their statement seems to claim that the very lear ruling only includes sentence one or that sentences two and three were too confusing for them to understand.

III. Conclusion

For the reasons stated above, Plaintiffs’ motion for summary judgment (Doc.
21), is GRANTED and Defendant’s motion for summary judgment (Docs. 47), is
DENIED.

IT IS FURTHER ORDERED that ALA. CONST. ART. I, § 36.03 (2006) and ALA. CODE 1975 § 30-1-19 are unconstitutional because they violate they Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment.

IT IS FURTHER ORDERED that the defendant is enjoined from enforcing those laws.

DONE and ORDERED this 23rd day of January, 2015.

2. Everyone is entitled to an opinion... but what did the ruling judge ACTUALLY say?

Did the Alabama Super-Duper Judge Club rule on this case from a conference room, or did a judge in a court of law? Methinks the judge would know their own ruling and to whom it applies.

3. The ruling said that Alabama's ban on same-sex marriage is unconstitutional and cannot be enforced.

that they might be able to ignore the ruling until it is upheld by a higher court. I hope that isn't true.

is optional in NM and either they marry ALL or none, as my county probate is choosing to marry none-their only ACTUAL have-to duties are probating wills and dealing with after-death duties. Is Alabama different? In NM, all clerks had to issue licenses after our court ruling. Maybe AL is different.

a Probate Judge in Alabama, told me last week that many other Judges are wanting to turn over Marriage License duties to the Public Health Dept. so as to cleanse their hands in the eyes of the Red Public.
