Jindal voucher overhaul unconstitutionally diverts public funds to private schools, judge rules

Louisiana Gov. Bobby Jindal's school voucher overhaul was dealt a blow Friday when a Baton Rouge area judge declared the diversion of public money by the voucher program to private schools unconstitutional.

The first part of Judge Tim Kelley's ruling declared that the law passed to implement the controversial program -- Senate Concurrent Resolution 99 -- was done in a valid and constitutional manner.

He also ruled Act 2 -- the voucher overhaul -- did not violate the "single object" requirement of the state constitution allowing for a bill to only effect one policy at a time.

But in the second part of his ruling, Kelley declared the diversion of funds from the Minimum Foundation Program (MFP) -- the formula under which per pupil public education funds are calculated -- to private entities was unconstitutional.

This is the program that has seen idiotic creationist 'teaching' material get public funding.

2. Don't particularly care about school vouchers but

 

I just wonder if this ruling applies to all the public-private prisons in LA? or maybe just for people trying to pay for private schools with a little bit of their tax money

9. Actually,

you DO need to care about school vouchers! (reply to Dookie not caring about vouchers). This is the repuke's way of taking government (our) money and giving it to private corporations (schools for profit) or religious institutions.
It is also a way to destroy the public system and those that work in it (teachers and their associations/unions).

Sorry! That's "Dokkie" - not Dookie!

6. This is an accounting decision not a legal one, the law is ok but the

money handling needs correction.

What a rump decision.

This is just an change to the general ledger, fixed in 2 weeks.

Thank God there are still some in LA with brains. This law was passed as a way to get funding for Bobbies run ar the presidency. It allows the transfer of public funds to private sector and I would bet a little renumeration in return would be given to the old war chest when it's time to run for the presidency. The ones that this would hurt are the children of a poorer quality education. But Bobbie can set back and stick out his chest and proudly declare I didn't take funds from the government. Oh by the was tuition for higher education has risen every year since Bobbie was elected and state aid has dropped.
