Post Election Romney and Bain Face a Federal Corruption and Perjury Hearing

It is absolutely true that Romney was looking forward to cutting his own tax liability to zero, privatizing the federal government, handing the Social Security Trust to Wall Street, and waging perpetual war, but with a plethora of investigations and allegations of corruption into his finances on the horizon, appointing a friendly Attorney General was certainly a primary reason for seeking the presidency. To date, Romney’s legal troubles include fallacious FEC and SEC disclosures, an investigation into him and his son’s connection to an $8.5 billion Ponzi scheme, and concealing over $15 million from the auto-bailout, and now his surrogate’s malfeasance and perjury in the eToys bankruptcy case.

Exactly ten days ago, this column reported on a Delaware bankruptcy court’s failure to enter an Emergency Motion into the public docket that included Bain Capital and Romney operative’s perjury and corruption in the eToys bankruptcy case. At the time it appeared the judge was protecting Romney and Bain Capital by suppressing the Motion in expectation he would win the election and have the Motion tossed out of court leading to the question; “is Romney’s main impetus for seeking the White House to appoint an Attorney General who will guarantee that all charges against him will go away?” Well now that he lost the election, it appears the allegation had merit because on November 7, the day after his crushing defeat, the Delaware bankruptcy court judge entered the motion into the public docket and scheduled a hearing for December 4, 2012; all on the same day.

It was a victory for the whistleblower and eToys investors, and incriminating for the Delaware court and Willard Romney because although the judge received the Emergency Motion on October 24th, it was withheld from the public docket until after it was clear Romney lost the election and would not be appointing an attorney general to drop the case. --


It is believable the Delaware court held up a legitimate Motion for 14 days expecting a friend of Bain Capital and Romney would head the Justice Department and dismiss the eToys case investigation, and the fact that the day after the election the judge granted a hearing certainly adds credence to the assertion. The good news, though, is that eToys investors and the whistleblower will finally have their day in court and without interference from Bain Capital’s lawyers, justice may finally prevail. However, it is bad news for Romney who told a mine owner facing a racketeering investigation that, “We get a lot of charges, this will go away,” because now that he is a regular citizen, this may not go away and he may face the same consequences as any other American. There are myriad implications stemming from Romney’s loss to President Obama last week, but for eToys investors and law-abiding citizens everywhere, the most important one may be seeing justice prevail.

In 2001, Bain Capital attorneys lied to the Chief federal justice of the Wilmington Delaware federal bankruptcy court; so that they could (illegally) seize the entire eToys public company and destroy it (devour it) for themselves.

Federal frauds and corruption appear to be the norm when it concerns Goldman Sachs & Bain Capital in Wilmington Delaware federal courts. You may have heard about the Matt Taibbi story "Greed and Debt" The True Story About Mitt Romney and Bain Capital. The Rolling Stone cover story denotes the fact that Michael Glazer (CEO of Kay Bee) - paid himself $18 million and then gave Bain Capital $83 million before filing bankruptcy of Kay Bee Toys. This, of course, is illegal for U.S. 47%'rs. But, when it comes to Goldman Sachs, Bain Capital and POTUS wannabe Mitt Romney - they are (apparently) - Above the Law.

The Clerk of Court violated the Law and blamed it on the Judge. When the PoliticusUSA reporter (Rmuse) called her and asked why - she hung up the phone on him (see previous article Court Clerk Indicates Romney & Bain Capital are Above the Law). As the PoliticusUSA story denotes, our briefing was withheld from the record until the day of the election (where it was too late to inform the public). Only after Romney lost the election, was the briefing put on the docket for a hearing (the docket states posted November 6, 2012 - received October 24, 2012 and the hearing paper is dated November 7, 2012).

all ill gotten gains should be RICO'd and Romney should be ordered to do public service.

If they prosecute him - even though we have slam dunk evidences against Bain Capital;
there will always be some bogus banter it was political.

However - if B O were to pardon him (or at least clemency) - then Obama would be immortalized;
and it would forever put to bed - any incongruous banter.

No matter what Obama does the Right will vilify him. I believe Romney did far more damage than Bernie Madoff-Madoff's ponzi scheme did great harm but wasn't widely copied; Mitt using CDOs witth subprime mortgages underlying set the standard for LBO financing. It also caused the mortgage meltdown; if your whole business is dependent on coercing people to buy houses they can't afford you're going to do everything in your power to get everyone to do it.

If Romney was a Chinese citizen, a resident of the only nation on earth that has capital punishment for severe financial crimes, Romney would have been executed years ago. What he did was that bad.

Paul Traub is Mitt Romney's other (secret) attorney.

He was partners with fraudster Marc Dreier (now in the News again = everywhere)

and - he was also partners with Ponzi Schemer Tom Petters (also in the News again - in MN)

Plus = Traub, Bonacquist & Fox (TBF) partner (Harold Bonacquist) works with Dan Quayle at Cerberus

Romney & Cerberus are the BIG benefactors from the TARP (and Cerberus's Gabriele Fund was inside Madoff)

Why...why do Democrats, taxpayers, and the duly elected President ... how do we get off "pardoning" a dishonest, lying, harvesting, POS who ruined many, many, many families? How would that immortalize Obama? Besides, he needs to toughen up a bit....no, a whole lot.

At worst, sentence him to community work, an 8-5 regular job, set an alarm clock...after which he and Ann can count their money and continue to live in luxury off the peasants whose livlihoods he harvested.

Marc Dreier got 20 years (10 was enough and 8 should be on probation)

Tom Petters got 50 years (10 was enough and 8 of such should also be on Probation)

OKUN 1031 Tax Group got 100 (and 10 is more than enough)

Madoff got 125 years (and why more than 10 - why not make it 1000 = sheesshh)

The persons who should get time here is U.S. Attorney Colm Connolly and U.S. Trustee Roberta DeAngelis and Mark Kenney

they swore an oath to serve and protect - taking tax paid public funds as a salary at 3 times the rate of average American

Punishing them "Properly" would send a clear message to stop the bull [c]hit

Since this is being handled at the Federal level, the Federal Sentencing Guidelines should be followed.

If Edwards (D) could be prosecuted and imprisoned, if Blagojevich (D) could be prosecuted and imprisoned, there's no reason to cut Romney any slack. His Republican status should not give him any de-facto immunity justifying clemecy or a pardon.

Granted -(and knowing) - Romney's perpensity for destroying the records;
chances are he will never do a day.

UNLESS - someone comes forward and testifies against him.

Traub, Gold, MNAT and the corrupt guys/ gals at our Dept of Justice should get years.

At Dade Behring Inc., a medical-testing company based in Deerfield, Illinois, Bain cut at least 1,600 jobs during a series of acquisitions before the firm entered into bankruptcy in 2002. Romney foreshadowed those cuts in a speech to employees shortly after Bain acquired the firm.

DDi Corp., an electronics company in Anaheim, California, filed for bankruptcy in 2003 after Bain sold shares in the company generating at least $85.5 million and billed $10 million in management fees.

GS Industries Inc., a steel company in Charlotte, North Carolina, filed for bankruptcy in 2001 after workers said a chief executive hired under Bain made missteps, including installing managers who lacked industry expertise, former employees said

Interviews with former employees and executives at Bain and companies it controlled, along with a review of Bain’s activities described in public documents and news accounts, paint a picture of an operation that wasn’t focused on expanding employment. Instead, Bain’s mission, like most private equity firms, was to generate gains for its investors.

an appropriate punishment might include his being fined in the amount of all the taxes he should have paid for all those years, and some time with "those people" who happen to reside behind bars so he can get acquainted with some of his fellow citizens whom he's been avoiding. It's certain that he'd be getting a penthouse suite of a cell but he'd be confined at that could drive him so far over the cliff that nobody will have anything to do with him once released. He's already teetering on the precipice.

I'm against that. It presents a chance for big gov to seize and leave no money for defense.

What a RICO indictment of Bain Capital would provide U.S. - is a chance to see what the taxes were "really" hiding.

Judge did the same thing in the eToys case.

Though they confessed to 34 acts of deliberate Perjury

she said no Perjury was documented.

is that we have known for at least a couple of years, maybe longer, that Mitt is a crook of the first order, yet people voted for him. I know someone who is a republican and we had several conversations regarding the presidential candidates, most notably Mitt. I presented him with facts regarding Mitt and Bain and I thought he was actually shocked to learn the truth. But, he still voted for Romney. WTF?

They are so prejudice against a non white man with a strange name

At least take his U.S. Passport away and ankle bracelet him. He is a flight risk to say the least. I would thing that he's already prepared for the "flee the country to avoid prosecution" plan, and is now executing it. Maybe he's headed for the bush CRIME family's Paraguay hacienda to bunk up with kenny lay boy there. Birds of a feather flock together....You know the drill...and so does mutt rmoney.

Bankruptcy Fraud Statute there is.

Including the one that has NEVER before been prosecute

18 U.S.C. § 155 Schemes to Fix Fees.

When attorneys lie to the federal court = to gain their (lucrative) employment = it is a crime.

It only as 3 requisites

That it be of a bankruptcy matter.

Benefit be "expressed" or "implied" (In this case we have "expressed" in vast details)

and that an oath/ declaration was required

Instead of suing each other for the millions (approx $3 million + to each firm) that was made
to get it "back" for the benefit of their clients

They circled the wagons and protected each other.

Looking forward to more. And even though I don't have much hope of him doing any jail time, he'll surely feel some discomfort at the uncertainty. He and Ryan brought out such horrid feelings in me, worse than Palin, and I didn't believe it possible.

I wonder if situations like this are the reason Obama has had so much trouble filling his judicial
vacancies. In his second term this must be a priority.

is the greedy business dealings since the eighties have brought the people down (decent jobs), has brought healthy american companies down and has affected families, communities and our country. just so a handful of wheeldealers could make more money off of schemes that destroy, gut some healthy companies.

enron is a prime example. deregulating in california where they basically screwed grandmas, and some employees joked about it. enron scammed their employees, their customers with little conscience at all.

My hearing alleges 19 NEW (novel) issues of Fraud & Perjury that the court has yet to address.

They had 26 days to respond (even though they were only allowed (legally) 10 days)

Instead - on Friday Night - they put in a Motion asking the court permission to take over my hearing,

and give them the latitude to NOT answer (in other words = tell me to go ==== myself)

AND

Today - the court granted their illegal requests and put in an order on November 20, 2012
that I must answer by November 20, 2012.

And I did (scramble) to get the answer in (not my best writing)

and the Court still is going to let them NOT answer for their crimes

It's basically all over = Romney/ Bain are back in control of Fraud & Corruption

and I'm doomed!

The 3rd Circuit Court has 2 Mormon Judges (Walter K Stapleton from the law firm www.MNAT.com and Judge Kent A Jordan who told the attorneys in eToys that "your lives are on the line here gentlemen"

then he was promoted to the 3rd Circuit Court 2 weeks later

and our case in the Delaware District Court was closed.

When we appealed to the 3rd Circuit

they said the Federal Rules of Appellate Procedure (FRAP)

Do NOT apply to this case.
