Appeals Court: Emails of former Walker aide can be used at trial

Source: ilwaukee Journal Sentinel

Kelly M. Rindfleisch, a former aide to Gov. Scott Walker, lost her attempt to reverse a trial court ruling that said she could not prevent emails obtained by prosecutors from being used at her trial.

A state Appeals Court Tuesday refused to consider the question, though Rindfleisch could raise the issue again after her trial if she's convicted. Rindfleisch, 43, is accused of four felony counts of criminal misconduct for doing campaign work while at her job as deputy chief of staff to Walker in 2010, when he was Milwaukee County executive.

The emails she sought to keep out of her trial came from two personal accounts and were obtained by prosecutors through a subpoena.

Tuesday's ruling was the third time the Appeals Court rejected or refused to consider pretrial bids by Rindfleisch. The court last month declined to take up her bid to have her charges dropped over a decade-old immunity deal and also wouldn't consider granting a temporary delay in her case.
