Ruth Bader Ginsburg Says Supreme Court Will Tackle DOMA Soon

Source: atlantic wire

During a routine question-and-answer session, a student asked whether the Supreme court would consider applying equal-protection clause to sexual orientation, effectively making D.O.M.A. and any other gay marriage ban illegal. Ginsburg deferred from answering:

Ginsburg said with a smile that she couldn't answer the question. She said she could not talk about matters that would come to the court, and that the Defense of Marriage Act would probably be up soon.

"I think it's most likely that we will have that issue before the court toward the end of the current term," she said.

2. That would be an interesting ruling if it happens

Not entirely sure how it would go either.

That type of thing is more than likely going to have some weird split ruling. Especially since Roberts seems to be worried the court is getting too political. But if they do make a ruling that makes gay marriage protected, I can't imagine the hate and anger that will spew from the religious right. I just hope they don't turn to violence.

3. Lawyers are good strategist

They want doma to go before the same court that did Citizens United and DC vs Heller. They have got to get DOMA in before Obama has a chance to change the balance of the Supreme Court.
