No jail time for Flagstaff cop in bar groping

After being convicted by a jury earlier this summer of sexual abuse for groping a woman in a bar, ex-DPS Officer Robb Gary Evans walked out of a Coconino County Superior Courtroom on Wednesday morning having been sentenced to two years of probation.

Prosecutors contended that he drank eight beers and then drove himself to the Green Room, where he flashed his badge in an attempt to get into a concert for free. While inside, he walked up behind the victim, who was a friend of a friend, put his hand up her skirt and then ran his fingers across her genitals.

Bad things can happen in bars, Hatch told the victim, adding that other people might be more intoxicated than she was.

2. Even more disgusting: the judge scolded the victim in this case.

She apparently dressed too skimpily and encouraged it.

Somebody needs to give this judge a swift kick in the nuts!

The judge sentencing Evans, Coconino County Superior Court Judge Jacqueline Hatch, said she hoped both the defendant and the victim would take lessons away from the case. Bad things can happen in bars, Hatch told the victim, adding that other people might be more intoxicated than she was.

"If you wouldn't have been there that night, none of this would have happened to you," Hatch said. Hatch told the victim and the defendant that no one would be happy with the sentence she gave, but that finding an appropriate sentence was her duty.

"I hope you look at what you've been through and try to take something positive out of it," Hatch said to the victim in court. "You learned a lesson about friendship and you learned a lesson about vulnerability."

Hatch said that the victim was not to blame in the case, but that all women must be vigilant against becoming victims.
"When you blame others, you give up your power to change," Hatch said that her mother used to say.

Reached today by phone, the victim said: “It felt like she was saying to me, ‘If you wouldn’t have been there that night, it wouldn’t have happened to you.’ Yeah, well, it probably would have happened to someone else.”

She said Hatch should apologize for her comments.

“I’m still kind of in shock that she said that to me,” the victim said later. “Coming from a woman, I would expect her to be a little bit more realistic about women being strong and independent and the fact that there’s nothing wrong with that.”

But why was he not required to register as a sex offender? I thought this was a country of laws.

10. hope this trial will prevent other women from being victimized

i guess this goes along with a theme last handful of days, tips for women to avoid rape and assault.

shouldnt be there.

well, there is the answer. no going out at night. get dark, lock self in house, and we will avoid rape and assault.

good for this woman taking it forward regardless of the hard work and insult in it.

12. Evidently, she has a history of filing false reports and having the police do her bidding.

Reading the comments on an article about this case, someone posted a link to a video of her threatening and totally traumatizing her seven year old grandson!!

17. Very good point. The whole incident shows Republicanism in action and it ain't good.

Police officer drives under the influence of alcohol (8 beers) to a bar, walks up to a woman and sexually assaults her, and the judge blames the woman who was assaulted for "being in the bar." Perpetrator gets probation.

That's Republican family values for you.

Judge Jacqueline Hatch issued a statement apologizing for comments she made to a victim of sexual abuse before sentencing an officer who groped the victim at a Flagstaff bar.

“As a Coconino County Superior Court judge, it is my responsibility to ensure that all victims and defendants are treated fairly and in a respectful manner in the courtroom,” Hatch wrote in the statement. “It’s a responsibility I take very seriously. I also believe victims should not be blamed for coming forward to report crimes.”

Hatch was widely criticized for comments that many took as blaming the victim for being in the bar. The victim and others present in the courtroom Wednesday said the remarks were inappropriate and likely to discourage other victims from coming forward to report sexual crimes.

18. Apology not good enough. I hope that the judge is voted out of office.

Also, small business owners (bar owners) should ask the judge why she is discouraging women from going to bars. Wouldn't that put the bar owners out of business? Attack on small business owners, looks like to me.

and a fucking bitch. Some women deserve being called such names. Judge Hatch is a disgrace to women. I doubt she's ever known how disgusting it is to have a strange man grab your privates. If she did she wouldn't have said what she did.

22. I'm sorry that happened to you. I think that you may have misunderstood my post.

All I'm asking is that you not use the words "cunt" or "bitch" to describe bad people. The implication is that all women are bad.

Please use insults that are non-gender specific. You can call the judge a hateful monster from hell. Just don't describe her in terms that are specific to women. That's all I'm saying.

and I won't take them back. You are the one who misunderstands words. the word cunt is not the same as the word vagina or woman. It is an insult and as such I mean it. Just like the word dick isn't a substitute for the word penis. Yet some people are called dicks. It infers that the person is an asshole, not some all man stereotype or all-man.

I'm certainly not calling her a vagina am I? And when I call a man a dick I'm certainly not calling them a penis.

So I suggest that if you don't want to use those words then don't. But spare me the lectures on language.
