Apple Loses Patent Lawsuit Against Samsung In Japan

Apple Inc. lost a patent lawsuit in Japan as a Tokyo judge ruled that Samsung Electronics Co. (005930) smartphones and a tablet computer didn’t infringe on an Apple invention for synchronizing music and video data with servers.

Apple was ordered by Tokyo District Judge Tamotsu Shoji today to pay costs of the lawsuit after his verdict, the latest decision in a global dispute between the technology giants over patents used in mobile devices. Samsung shares rose, erasing earlier losses.

“It’s hard to believe the products belong to the range of technologies of the claimant,” Shoji said in dismissing Apple’s case.

Apple and Samsung are battling over the smartphone market, estimated by Bloomberg Industries to be worth $219 billion last year, with patent disputes being litigated on four continents. Apple won a $1.05 billion verdict in the U.S. on Aug. 24, with a jury finding that Suwon, South Korea-based Samsung infringed six of seven patents for mobile devices. The two companies are also bound by commercial deals involving components supply.

Only in the state that apple started do they win a lawsuit against their competition .... ? Heh, they don't call it homefield advantage for nothin ...

1. My boss was right yesterday!

I'm in the wireless biz - HQ for a major carrier. His take - guy with 30 years in the business that actually set up Samsungs distribution centers back in the 1990's . . . Wait until they leave the US!

It's kind of funny to watch our vendors turn on each other like this. Normally they are a band of brothers trying to do anything and everything they can to stick it to their customers (the carriers that subsidize the devices for the consumers).

2. Apple's been winning suits and injunctions all over the world.

That was just one small suit, many more to come...

...and Apple is currently in negotiations for a settlement with Google/Android to avoid a trial that would make the Apple/Samsung trial look like chickenfeed.

Samsung screwed Google, but good.

Apple is expected to make about $30+ on every Android sold when the dust settles.

5. Apple cannot make its devices without

Samsung's capacitive matrix screens. Samsung has a monopoly in those.

Samsung will just charge Apple more for the screens.

Samsung will not cut their own throats.

When flash memory companies could not keep up with Apple's needs, the memory companies threatened to jack up rates, rather than expand their capacity.

Apple bought their own flash memory company. Suddenly, Apple got first priority from these other companies.

4. patent wars by Sun Tzu

Apple's American platform of attacking their enemies plans is the first best plan of winning a patent war with Samsung without actual physical engagement according to Sun Tzu's "The Art Of War. " Apple's war on Samsung falters after that first plan is executed. The second best plan of winning a war is attacking Samsung's alliances which to the dismay of Apple is all of Asia. And the other best laid plans to win wars are not in favor of Apple. Steve Jobs couldn't even win this..
