Bill O'Reilly, Greta Van Susteren Sued For Defamation, Emotional Distress

A New York business owner has sued Fox News hosts Bill O'Reilly and Greta Van Susteren for defamation and emotional distress.

Drum Cafe owner Aviva Nash filed a lawsuit alleging that the Fox News hosts accused her of stealing from U.S. taxpayers. The dispute stems from two different segments that aired on Van Susteren's "On The Record" on July 19, and "The O'Reilly Factor" on July 25. Both segments focused on an investigation launched into a General Services Administration awards ceremony that cost more than $250,000.

Clips of drumming were shown during Van Susteren and O'Reilly's respective segments, as the GSA awards ceremony included an expense of $21,000 for 4,000 drumsticks for attendees. Nash claims that her footage of drumming from her business was shown during the segments. It's unclear whether the video was used as stock footage or for some other purpose, but Nash and Drum Cafe were not identified by name. Both Van Susteren and O'Reilly criticized the GSA for using taxpayer money for such an event.

2. All the media networks use "stock footage" of all types.

 

This will affect everyone. Which is fine by me.

4. yeah but they don't use stock footage in false ways like Fox. Remember how Fox used "stock footage"

to make it appear Glen Beck's little Washington get together was more popular than what it was.

3. How could they accuse her of stealing without mentioning her name?

Somehow this is going to turn into Fox's corporate lawyer team( soon to be a Saturday morning cartoon!) filing a counter claim against her for a frivolous lawsuit. I wonder if she has representation. It could be a violation of fair use if she or her customers were featured in stock footage in a story with negative depicitons...interesting. ..would love to see the complaint

11. You've linked to eCourts, which typically doesn't have copies of complaints and the like.

New York State courts have no general requirement of electronic filing, so it's quite common that a complaint or other paper is not available online. In fact, I don't think I've ever seen anything on eCourts except for decisions and orders of the court.
