9th Circuit ruling favorable for Occupiers to hold police, gov'ts accountable for excessive force

A three judge panel of the 9th Circuit U.S. Court of Appeals filed an unanimous ruling in Nelson v. City of Davis. The student plaintiff, Timothy Nelson was seriously and permanently injured by the excessive use of force by police in a 2004 incident at UC Davis. The Court found that the police actions violated a basic constitutional right, the Fourth Amendment right to be free of unreasonable seizure and invalidated qualified immunity for the police, meaning that police could be held liable for damages. This ruling should offer considerable support to Occupiers pressing suit against police and governments for their often brutal and excessive use of force against peaceful protesters. While there are Law Enforcement that do good work (I guess), I'm so OVER these Local-Yokal-Militias, beat'n the
snot out of American citizens that are tax payers. I'm sure that the Radical Activist 5 on the Supreme Court would toss this. |

12. it is time to get rid of "insurance" for police misconduct.............

and take it out of their pension/health plans.
Any cop who was not brain damaged would be looking out for his/her future & retirement, instead of killing & beating people for fun. |

Brutal force? We hear stuff like this coming out of other countries but, it is never covered in this country. Do we have to listen to foreign news to hear about the Occupy Movement in the US? It is time the stories come out!
