Louisiana Gov. Bobby Jindal refuses to implement Obamacare despite Supreme Court ruling
Source: Yahoo
The Supreme Court upheld President Barack Obama's health care law on Thursday, but Louisiana Gov. Bobby Jindal, a possible Republican vice presidential contender who has refused to establish a federally mandated health care exchange in his state, said Friday that he will continue to ignore it.
"We're not going to start implementing Obamacare," Jindal said during a conference call with Virginia Gov. Bob McDonnell. "We're committed to working to elect Gov. Romney to repeal Obamacare." Under the Affordable Care Act, states must set up a health insurance exchange program by Jan. 1, 2014, and will receive grants from the federal government to implement it. Several Republican governors, including both Jindal and McDonnell, have put off setting up the exchanges in the hope that the law would be repealed or struck down by the court. Now that the law has been upheld, Jindal said he won't change course and is looking to presumptive Republican presidential nominee Mitt Romney to lead the repeal effort if he takes office in 2013. "Here in Louisiana we have not applied for the grants, we have not accepted many of these dollars, we're not implementing the exchanges," Jindal said. "We don't think it makes any sense to implement Obamacare in Louisiana. We're going to do what we can to fight it." Last edited Fri Jun 29, 2012, 04:57 PM USA/ET - Edit history (1) This should be what the Dems talk about on guest appearances on TV. They are setting the tone for out and out disorder, unlawful acts, and defiance of our own laws. The party of "Law and Order" has become the party of lawlessness and disorder. They have effectively stopped the fight against illegal arms sales to foreign countries thanks to the NRA influence, they are encouraging more fraud and abuse by fighting against more regulation of the banking and other financial institutions, and they are encouraging outside terrorists to use their anti-government rhetoric to attract anarchists and foreign sympathizers with terrorists groups like al-quadea to swell their ranks with anti-American hooligans.

21. Every time I think of Pickett's Charge, I remember the exchange between Picket and Lee
|
After the attacked had failed, Picket, who as commander of the attacking unit had stayed in the rear, where he belonged, so he could better direct the attacking units (i.e. shift any artillery support as needed, shift reinforcement units as needed).
Anyway, after the charge had failed, Lee was forming his surviving units to resist an expected Union Counter attack. Seeing Picket just standing around, he yelled at him to get his men ready. Picket's response is legendary "I have no men". Lee's response is also known "You did not lose them, I did" and rode away to prepare for the expected Counter attack (Which did NOT occur). |

80. Southern Manifesto
|
Last edited Mon Jul 2, 2012, 10:56 AM USA/ET - Edit history (1) This is a more fitting reference, on the grounds that it involved many states, not just Virginia.
Southern Manifesto The Declaration of Constitutional Principles (known informally as the Southern Manifesto) was a document written in February and March 1956, in the United States Congress, in opposition to racial integration in public places. The manifesto was signed by 99 politicians (97 Democrats) from Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Texas, and Virginia. The document was largely drawn up to counter the landmark Supreme Court 1954 ruling Brown v. Board of Education. |

For states that don't set up exchanges to implement the law, Pres. Obama will send federal carpet baggers in to set it up and operate it. That means no participation by the state. I don't think that Bobby wants to lose out on the "control" and patronage.

Its the Health Insurance exchange provision and the law never mandated that a state set one itself. States were always allowed to elect not to do so and to let the federal government set up the exchange in that state. There is no penalty in the law for a state that doesn't set up its own exchange.

47. Governor Piyush Jindal is such an embarassment for our state.
|
I 100% hope he is selected to run for V.P. so he can get the hell out of here. But wait, that would only work if the Republicans win the White House. Oh god. Four more years of Piyush Jindal.

Kind of like the repukes emphasizing the "Hussein" in Barack Obama.

Good for him. With Roberts on our side now, Jindal will be out-voted soon enough.

Then the Feds will do it for him -- for example, setting up an exchange. At least, that's the way I understand ACA works.

75. Correct. The law doesn't require states to set up exchanges themselves.

76. No, they won't suffer because under the law if a state opts not to set up an exchange,
|
the federal government does it for them.
I don't approve of any governor or state legislature deferring to the federal government to set up the exchanges, but the allows them to do so and a lot of the comments on this thread appear to be based on a misunderstanding of the law. |

77. And how do you propose to do that?
|
And, by the way, the law doesn't require a state to set up exchanges -- in fact it expressly allows states to opt out of doing so, in which case the federal government will step in and set up the exchange for that state.

79. I must admit ...
|
I haven't read every comment in this thread (so forgive me if I'm repeating another comment); but Jindal (and McDonnell) refusing to set up the state exchange is a good thing in the march to single payer.
Their refusal (failure) triggers the provision in the ACA where the fed sets up and runs the exchange. Bobby "Deer in headlights" won't be able to later claim that he did something on this matter, as he did with the stimulus dollars. But there is nothing in the law that would prevent the fed from including a Vermont-style single-payer option as one insurance choices. You hear that Kathryn Sebelius? In every state that refuses (fails) to set up the exchanges, include a public option as a choice. |

83. Good ...
|
So we can have public options in the federally created exchanges in three states.
I'm holding out hope that Arizona will do likewise; but from what I understand, this state has drawn down some set-up funding. |
