Jerry Sandusky Penn State Abuse Secret File Points To Institutional Cover-up (updated)

Allegations of an institutional cover-up of the Penn State sexual abuse scandal reached a fever pitch on Monday after sources at the Attorney General's Office indicated that former Penn State vice-president Gary Schultz kept a secret file on Jerry Sandusky's alleged abusive incidents, casting doubt on his previous grand jury testimony, KDKA-TV reports.
Only recently was the commonwealth provided with a file containing documents relating to incidents involving Sandusky," Attorney Generals office said in a statement. The file was created, maintained and possessed by Schultz. Documents in that file are inconsistent with statements by Schultz and his co-defendant, Curley, to the Grand Jury."
The Attorney General also mentioned emails between Curley, Schultz and what KDKA-TV reports as "other high-ranking officials" that directly contradict Grand Jury testimony.
Penn State maintains the files in question were "immediately turned over."

Its sort of hard to believe that folks could have behaved even more poorly in the events surrounding the coverup of former Penn State football coach Jerry Sanduskys alleged sexual abuse and assault of children he met through his Second Mile charity. But as his trial is underway, it appears my beliefs have been confounded: Pennsylvanias attorney general is now suggesting that former Penn State vice president Gary Schultz kept a file on Sandusky, and that in emails between him and former Penn State president Graham Spanier suggest that university officials thought it would be more humane not to report Sandusky than to report him. Trust me...Whether through official or un-official information channels, a president knows *everything* that is going on within his campus...

I have always felt the sports programs run the institutions.

(263 posts)is a state university and I believe the State Government knew and help with the cover-up. Also keep in mind our Governor now was the State's Attorney General when a lot of this stuff is happening.
Maybe an insane theory but I wouldn't be surprise if we do find that happening.

(25,704 posts)No, each raped kid gets his own jury. The institution would have to keep their lies consistent and every new case puts more ammo in the gun of the next trial. The class action would only benefit the lawyer who files it, not each kid. Penn State would love to do a class action, it prevents a slow bleeding and allows them to get it behind them. Once one trial is won then the price of each of the next ones goes up.
BUT, I looked at the Pennsylvania tort immunity laws when this broke and PSU might be immune or have their damages capped.

Sports bribery and other predicate acts are listed 18 USC § 1961.
It would, of course, be up an attorney making a claim the the civil RICO provisions are applicable to describe the facts constituting the predicate acts.

(36,437 posts)Without some evidence of this kind, the case against Curley and Schultz was essentially doomed, since it rested solely on the testimony of Mike McQueary, who was dubious at best as a star witness.
If this bears out, then there might actually be perjury convictions in the offing, at least against Schultz.

"Then-Centre County District Attorney Michael Madeira transferred the case to then-state Attorney General Tom Corbett in March 2009. Corbett, now governor, declined comment through his spokesman."

He did next to nothing on it, assigning only one investigator to the case and it wasn't until Frank Noonan took over that more investigators were added to the case. Here is a snippet from an article about questions re Corbett's seeming dragging of his feet on the case:
"Just as they did during the legislative corruption investigation, people are accusing Corbett of dragging his feet on the Sandusky case for political purposes.
At that point in the case, only one investigator a state police trooper was handling the case, and it only involved one accuser, the now-18-year-old man from Clinton County known in court records as Victim One.
It wasnt until January when Frank Noonan took over as state police commissioner that seven more investigators from the state police and attorney generals office were added to the case."

In the above link, there is also information about campaign contributions to Corbett from Second Mile while he was a candidate for Governor and still the Attorney General in charge of the Sandusky investigation.

(135,425 posts)do anything to move the case forward back then, perhaps because of a school as well as his possible Sandusky connection--i.e., that in effect, he was a piece of the conspiracy puzzle to sweep this under the rug.
Well, that sounds entirely feasible to me...! It seems like this case is rife with deliberate mishandling--and it seems like Sandusky and his late boss the coach, to say nothing of the school bigwigs, knew pretty much everyone in the state.
I'm not from PA, so I'm a bit slow on the uptake with the "inside" politics angle...!

(50,232 posts)I was merely trying to provide what was known at the time about then Attorney General now Governor Corbett and to provide links to articles that flesh out some of the questions still circulating about Corbett's actions and lack of action within the time frame when the 2009 investigation of Sandusky took place.
As to your comment re "It seems this case is rife with deliberate mishandling--", I completely agree with you and believe it occurred at all levels.
