Judge declines request to delay challenge of Nebraska's gay marriage ban

A federal judge in Nebraska is not going to wait on the U.S. Supreme Court to decide the issue of gay marriage.
U.S. District Judge Joseph Bataillon has declined the state's request to delay a court challenge on the state's gay marriage ban, pending a decision expected from the high court later this year.
Bataillon noted that one of the women who is challenging Nebraska's gay-marriage ban has terminal breast cancer. She has argued that she suffers "irreparable harm" each and every day she is not allowed to marry her partner.
Bataillon said in his order Tuesday that he saw no reason to delay the case, saying the couples who have filed the lawsuit are entitled to have their case heard.
