JMO, but if they keep the ACA except the mandate, the media will portray it as a stunning defeat for Obama. If that happens, I would encourage the President to go back to the drawing board and find another way to fund it. The other provisions are very popular with the public.

My hope (of course) is that it will not be struck down in part or at all. Nancy Pelosi predicted 6-3 in favor. Hoping she is correct.

It is likely they will add at least one other day this week as there are a few case decisions left to announce.

If they uphold the law it is an obvious win.


If they strike down the mandate as a stand alone clause it is an even bigger win since that was a RW idea anyways. It would force some other mechanism to help the insurance companies protect their profits (we all know it will happen) and a public option might be possible. An employer mandate is even more likely.


If they strike down the entire law the backlash will be overwhelming. Removing ~2.5 million young people from their parent's policies. Removing prescription drug coverage for seniors who were in the "donut hole". Allowing insurance companies to spend less than 80% of revenue on treatments. Reinstating the co-pays on wellness visits. Everyone who has some coverage removed, and everyone who cares about someone who has some coverage removed, will be outraged.



I know everyone is anxious for the decision, I am too. I am just sticking to the same assumptions I had when this whole thing started. I just don't see any way for us to lose politically no matter what the decision is.

As a matter of policy I hope the law stands (with the possible exception of the individual mandate) if for no other reason than to save lives.
