“It is likely that the sharp disagreement rate will go up next week & the week after” Ginsburg said.

Although she offered no insight into the tightly held decisions of her colleagues, Ginsburg did indicate that many of the court’s decisions over the next two weeks — which are also expected to include an FCC indecency ruling — might be close.

The 21 remaining decisions, she said, were “many of the most controversial cases” that the court reviewed this term.

“It is likely that the sharp disagreement rate will go up next week and the week after,” she said.

As SCOTUS wraps things up to end the term. Apparently lots of chair throwing going on during conferences.

I am hoping the Kennedy has flipped to the left in disgust.

Chair throwing is NOT the way the Court does business, unlike some members of Congress and State legislatures.

There MAY be a number of i's to dot and t's to cross, in the several 'interesting' cases still pending, and they have the task of crafting decisions which are consistent with previous decisions; if they've decided to change some previously held positions, they'd do so with care. This crafting/editing/rewriting can be very difficult, time-consuming and stressful. Among the decisions pending, 'The court in the next two weeks will rule separately on health care, Arizona's controversial immigration crackdown law, television broadcast indecency enforcement, and a federal law making it a crime to lie about earning high military honors.'
