It was a ridiculous thing to say, especially after talking about how the GOP will try to block the nomination until after the election. So I guess we don't even need a 9th justice for the next year?

......I think the remaining justices will simply take a page from the Democratic Iowa State Caucuses and solve the dilemma with the toss of a coin.

The lower court decision stands and there is no Supreme Court precedent. In fact I don't think either side even publishes an opinion.
