How messed up is our country where what Bill O'Reilly says matters as to national discourse?

We are out of control.

Has fox been playing speech after speech by W saying the same things Obama is saying?

Bet not

But as a guest on Lawrence said last night, while W was saying the right things about Muslims, his actions were bombing them, etc.

prosecute Bush/Cheney for torturing detainees to elicit coerced confessions which were used to falsely lead the nation into war?

In general, if you want to do something and you get an opinion from the attorney general saying, "yeah, you can do that" then that is a solid defense against criminal prosecution for doing what the attorney general said you can do.

That's *why* they had Alberto Gonzales signing opinions from his hospital bed.

The prosecution would be wrapped around that fencepost for a good long time before getting anywhere near a trial.

...the bottom line is that they will rely on opinions obtained from the AG's office as an affirmative defense.

Whether those opinions were correct, well-founded, or whatever is not particularly relevant to the situation of a defendant who is entitled to rely on an opinion of the AG.
