Stand your ground...or get outta my way...er, get your dog outta my way!!

St. Petersburg man shot over dog that lurched in front of car

ST. PETERSBURG A man walking his dog was shot in the leg by a disgruntled motorist when the animal lurched into the road, forcing a pickup to stop.
- snip -
St. Petersburg police are searching for a man who shot Peter Harbachuk, 46, on Friday after his dog got off its leash.
The canine seemed fine, but down the street Bella got spooked by a neighbor's dog, Harbachuk said.
-snip-
"Some dude hopped out and he pointed a gun toward my head," Harbachuk said. "I said, 'Hey. This doesn't have to go down like this.'" The man lowered the gun a bit, closed his eyes and squeezed the trigger, he said. He and the woman quickly sped away, and police and paramedics arrived soon after.

---------------
This gun thing is completely out of control (and I own guns). It's a power thing now, and some folks should never possess a gun. The guy who came to spray my house for bugs last week had a gun. I asked him about it, and he knew all the NRA talking points. I can get a different exterminator, but this propaganda war is crazy. I grew up on military bases, took NRA safety courses, and went hunting in the 50s and 60's. I never heard or saw anything except respect for safety and special care around any gun (back then). Even for self-protection, we were taught to get away if we could and only defend ourself if we absolutely were trapped. Now, you never know if you're safe walking your dog, getting a pizza, or slowing down to make a turn. The nut behind you may just be armed (and dangerous).

Personally, I think you should have a license, guns should be registered, possessors should take courses, have insurance, and go through serious background checks, including an emotional/mental health evaluation. Florida is turning into the wild west.

4. That exterminator would have been turned away

if he'd showed up at my house. No way I'm letting anyone with a gun into my home, unless it's because I've called the police, and I'm a gun owner (for defense only). This is getting way too serious.

5. I only saw it when he was leaving and I was paying the bill.

Otherwise I wouldn't have let him in...but I asked him about it. He's an independent contractor, and said he had a permit. He had "rights", etc.

Obviously, I got on Angie's list five minutes later and found another bug company. I just don't like the idea of all these folks carrying guns around. I have never carried a gun anywhere except from the gun safe to the range and back.

Actually, I don't hunt or shoot anymore - Florida's just too crowded and I'm not interested. The fishing is nice though.

I told my wife recently, that I may just drop the guns at the next police buy back. I wouldn't sell them to a stranger since they may end up on the street and there are just too many guns around here.

17. He has *zero* "rights" to carry on your property.

I would have asked him to dis-arm, or leave, his choice.

19. Yep...

His rights are seriously under scrutiny when he steps onto your property and seriously curtailed when stepping into your house. Public property may be up for discussion or not, but private property is a whole different ball game.

20. I really don't know...

here in Florida our crazy legislature is constantly passing laws to allow guns everywhere. I think we stopped them from allowing guns in schools, but they tried. It's a good question though? I'll try to find out.

6. It'll be interesting to see how this comes out

This guy is a poster child for "should have the book thrown at him", on general principles and from both sides of the gun control debate. Wonder whether that will happen.

10. Fully agree

At the minimum assault with a deadly weapon; personally I would go for attempted murder.

While I am pro2A I have no issue with enhanced penalties from crimes involving a gun or dangerously irresponsible behavior.

13. Meanwhile, 'lawful' asses with guns keep doing unlawful things with them.

So when we are done being "extreme", we'll still need a calculator to keep count of the bodies stacking up.

16. gun rights on my property?

My wife and I live in Florida and are deeply concerned about the use of the stand your ground law by gun humpers to get away with murder. I have met many gun owners that are rational- but the gun humpers are different; they seem sexually excited by the prospect of shooting someone and getting away with it by claiming an imagined threat. And because gun humpers are craven cowards in a never-ending state of absolute terror of president blackenstien- they represent a serious threat to rational. normal folks.
We have decided to let all of our gun-humper acquintances know that they are not allowed to bring guns onto our property. There will be no warnings or discussions about it. If a gun humper brings a gun onto my property we will contact the leo immediately and press illegal weapons possesion charges. My family's safety is more important than a gun humper's fetish.
Does anyone know how many unlawful gun possesion charges it takes before a gun humper loses the right to own said gun?

18. It should be illegal for anyone to possess a firearm while on someone else's property

unless they have permission. With the LEO exception.

21. Here's the section of the Fl law I think...I'm not a lawyer...I don't see a restriction...

2. Any police, sheriff, or highway patrol station;
3. Any detention facility, prison, or jail;
4. Any courthouse;
5. Any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom;
6. Any polling place;
7. Any meeting of the governing body of a county, public school district, municipality, or special district;
8. Any meeting of the Legislature or a committee thereof;
9. Any school, college, or professional athletic event not related to firearms;
10. Any elementary or secondary school facility or administration building;
11. Any career center;
12. Any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;
13. Any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile;
14. The inside of the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or
15. Any place where the carrying of firearms is prohibited by federal law.
(b) A person licensed under this section shall not be prohibited from carrying or storing a firearm in a vehicle for lawful purposes.
(c) This section does not modify the terms or conditions of s. 790.251(7).
(d) Any person who knowingly and willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

without permission of the property owner.
