Father Who Beat Daughter's Rapist To Death Will Not Face Charges

Hearing his 5-year-old daughter crying from behind a barn, a Texas father ran and discovered a man raping her. The father pulled the man off his daughter, and started beating him to death with his fists.

According to The Associated Press, the father frantically called 911, begging a dispatcher to find his rural ranch and send an ambulance.

"Come on! This guy is going to die on me!" the man is heard screaming on the 911 call: "I don't know what to do!"

A recording of the tape was played during a news conference Tuesday, where the Lavaca County district attorney and sheriff announced that the father will not face charges.

11. I think it was closer to accidental death, myself.

The guy didn't intend to kill the guy--otherwise he would have waited until he was already good and dead to call 911.

He was just very, very angry and his anger was entirely justified. As a consequence, he didn't know his own strength.

19. Suicide by Being A Dispicable Asshole is how I'd rule it!

That guy's fate was self-inflicted.

I'm sure they came up with something a bit more officious, like "blunt force trauma" or some other handy phrase we hear on the crime shows! The Brits would call it something like "death by misadventure" I would imagine...

37. instant karma.

i just can't feel sorry for the rapist. i'm hoping the father doesn't agonize over it; he did what all fathers say they would do in that situation. he actually knows that's what he would do, because he did.

He needed to make sure the man was unable to further assault her.

Good riddance to the monster.

33. Right. If he had shot him or stabbed him or used a blunt instrument to his head it was

in defense of his child. No way a parent doesn't know that a rapist isn't also a killer.

because it would be impossible to find a jury to convict someone.

5. The right call--temporary insanity plea would make a jury conviction

virtually impossible. Who could say with any definitiveness they wouldn't do the same?

As for the fathers action, I'm mad just thinking about it, to actually see it happening? No jury in the world would convict.

7. I don't know any parent who wouldn't have done the same

I've seen a parent, the most mild-mannered person I know, have his flip switched when his toddler was attacked by a cat. I can only imagine what he, or anyone for that matter, would have done if they saw their baby girl being raped by some sick piece of shit.

he caught the rapist in the act.

12. When I lived in Texas, the county I lived in made it legal to confront

trespassers and kill them usually with a gun. No one would go to jail. I don't know if it's all over Texas but at least that was the law where I lived. I imagine if the rapist was a trespasser, that law would be effective and the man who beat up the other man on his property wouldn't be charged even if there was no other violation involved.

I don't approve of extra-judical killing, but anyone raping a 5 year-old, or anyone of any age for that matter, isn't going to get my support in a "no fair trial' grievance. Good riddance to the bastard...

God.

And the father--doing his best to protect his baby, what both of them must be going through is unimaginable. I could just cry for both of them. I hope the little girl and her Daddy are able to heal, together.

31. Who wouldn't have had the same reaction as the father?

...I honestly don't think the father meant to kill him, re his call to 911. It wouldn't have mattered to me... I would gladly have gone to prison for taking out the SOB that I caught in the act of raping my little girl. I do hope that the child was not so injured that she couldn't run to the house and therefore not be a witness to what her father did. What a fucking nightmare of a situation.
